According to the National
Association of REALTORS the number one key to
successfully achieving your new home goals is to
hire a highly experienced and
customer-service oriented residential real
estate professional with the coveted REALTOR®
designation.
When
you hire a highly trained and experienced
REALTOR, by retaining their services by
executing a "Buyer Agency Agreement", the broker
will represent your best interests,
provide guidance, information and assistance
throughout the transaction process.
The
following additional information can save many hours of time and thousands of dollars ! As a potential home buyer
in Colorado, you need to know the following:
* Only a
Buyers Agent can help you in negotiating the lowest possible price!
* Only a portion of currently available houses are shown on the internet.
(Statistics show between 30 and 50 percent of
the available properties are not on the
internet)
*
Many of the homes on the internet
are already under contract e.g. SOLD
(20-40 percent)
*
Colorado real estate laws differ significantly
from laws in all other states.
Here's one example. Under Colorado Law there are three types of real estate agents (three
types of "agency" relationships):
1) Seller's Agents - those under contract and working
specifically for the seller. The names of
these people appear on the yard sign in front of
the homes for sale. These brokers and the
company they work for represent the interest of
the sellers. Therefore, they do not
represent the interests of a potential buyer.
There is no "Dual-Agency" in Colorado, as might
exist in other states.
2)
Buyer's Agents - a broker specifically under
a "Buyer's Agency Contract" and working specifically for the
best interests of the buyer.
3)
Transaction Brokers - a broker who is not
under contract with either a buyer or seller.
Without an executed contract, the broker is not
specifically representing either a seller or buyer, but
will remain neutral during a transaction.
The
Colorado Real Estate Commission believes it is
vitally important that every potential
residential real estate buyer and seller in
Colorado fully understand the three types of
relationships you can have with a Colorado
licensed broker. The Commission therefore
requires that the first step in the real estate
process is for you to receive a disclosure form
explaining the three types of agency
relationship you can have with a Colorado real
estate broker. Every broker is
required by law to present you with this form
and you are required to acknowledge receiving
this document.
